The panel members were Mr Jim Atkins PPNAEA (Honoured) (member panellist acting as the Chairperson for the Tribunal), Mr David Coleman MARLA FNAEA (Honoured) (member panellist) and Ms Gillian Fleming (lay panellist). The presenting Case Officer for Propertymark was Miss Laura Hanley-Gorton. The member declined to take part in the disciplinary hearing.
The Tribunal considered the allegations set out in the case summary sent to Mr Harding on 29 September 2020. It was alleged that Mr Harding had acted in contravention of the requirements of the following Propertymark Conduct and Membership Rules.
- Conduct Rule 1.27: Submission of report or HealthCheck
- Conduct Rule 21: Continuing professional development (CPD) rules
The Tribunal considered the evidence provided by the Case Officer and the submissions from Mr Harding before reaching their findings.

Mr Harding submitted a plea in mitigation by an email dated 9 October 2020 for consideration by the Tribunal.

In addition, costs were imposed of £168 against Mr Harding in favour of Propertymark.
The Tribunal made the following statement:
“We are disappointed that Mr Harding has been non-compliant in respect of both admitted breaches for such a long period.
The breaches of Rule 1, particularly 1.27, have continued despite automatic fines for a number of years which the panel find unacceptable.
In addition, CPD is an essential part of a practitioner’s continuing education. With ever changing legislation this must be carried out and recorded.”
