Notice period documents and guidance on Pre-Action Requirements published

The Scottish Government has recently published updated versions of the Model Private Residential Tenancy Agreement, Easy Read Notes, Statutory Terms Supporting Notes, Notice to Leave, and Form AT6. Guidance has also been published to support agents and landlords following the introduction of the Rent Arrears Pre-Action Requirements (Coronavirus) (Scotland) Regulations 2020.

The updated documents come as part of the Government's introduction of new regulations that changed the length of notice periods landlords must provide tenants when using certain grounds for possession whilst the Coronavirus (Scotland) Act 2020 is in force.

The newly published guidance aims to support agents and landlords with their understanding as to the actions they are required to meet when seeking repossession on the grounds of rent arrears

The guidance includes useful information such as:

  • Information for tenants regarding their rights around evictions and the pre-action requirements
  • Details of the available funding and financial support tenants can access
  • Template letters to help ensure tenants are receiving the right information and support from agents and landlords
  • A spreadsheet to help tenants work out their affordability when calculating a suitable payment plan.
