How our members are regulated
Agents join Propertymark voluntarily to showcase their commitment to providing exceptional service and help ensure they remain at the forefront of the industry. We hold our members accountable to protect consumers and provide peace of mind when they see a Propertymark Protected logo.
Client Money Protection (CMP)
All members who handle client money are covered by CMP and have their client account inspected annually. It is fundamental for tenants, landlords and other agency clients to ensure their money is protected if the worst happens: the agent goes bust or misuses rent, deposit or other funds.
Independent redress *
We ensure our members belong to one of the Government-approved independent redress schemes: The Property Ombudsman (TPO) or Property Redress Scheme (PRS). Redress schemes provide fair and reasonable resolutions to disputes between members of the public and agents.
Professional indemnity insurance
We check that our members hold the appropriate professional indemnity insurance, which provides cover for legal costs and expenses in claims resulting from negligence or breach of professional duty. It also covers any damages or costs awarded to consumers as a result of negligence.
Across the entire sector there is no standard requirement to be qualified. Our members and fellows have sought to become qualified in their profession to showcase their commitment to higher standards. Their qualification proves they have the knowledge required to offer the best possible service.
To uphold our high standards, all members are obliged to comply with our Conduct and Membership Rules. Disciplinary hearings are arranged when serious breaches occur; a tribunal will consider the case and impose sanctions on the member if they are found to have breached our rules.
To avoid hefty fines, we confirm our members' registration with the Information Commissioner’s Office (ICO) who uphold information rights in the public's interest. We also check that our members are registered with HM Revenue & Customs (HMRC) for Anti-Money Laundering supervision.
