How to read the room

With the enforcement of the Digital Markets, Competition and Consumers Act 2024 (DMCC Act) from April 2025, estate agents are now legally required to disclose all material information in property listings.

This includes accurate measurements, room types, and room sizes. The omission of such information is now automatically considered an unfair commercial practice, regardless of intent, and may result in significant penalties including fines of up to £300,000 or 10% of global turnover, and even imprisonment for directors in severe cases.

This course provides a comprehensive understanding of the legal obligations under the DMCC Act, following the withdrawal of NTSELAT’s previous guidance (Parts A, B, and C) in May 2025, and explains the RICS code of measuring practice by looking at the correct way of measuring rooms and how to accurately describe room sizes using examples. It examines the validity of disclaimers and outlines due diligence defence.
