Mr Sean Barrett MARLA

A disciplinary tribunal of Propertymark Limited was convened on 27 February 2025 to consider the case against Mr Sean Barrett, Director of The Agency Group – TAG Limited t/a The Agency Group.

The panel members were Mr Neville Pedersen FNAEA (Honoured) (member panellist acting as the Chairperson for the Tribunal); Mr Steve Shaw (lay panellist); and Mr George Close (lay panellist).

The presenting Case Officer for Propertymark was Mr Ali Haider. Mr Barrett was in attendance at the Hearing, accompanied by Ms Emma Burke. Ms Rakhi Rahi, the complainant, was in attendance at the Hearing.

The Hearing took place in private and was recorded.

Allegations

The Tribunal considered the allegations set out in the case summary sent to Mr Barrett.

It was alleged that Mr Barrett had acted in contravention of the requirements of the following Propertymark Conduct and Membership Rules.

  • Conduct rule 10: Declarations
  • Conduct rule 13: General duty to uphold high standards of ethical and professional behaviour
  • Conduct rule 23: Continuing professional development (CPD) rules

Decision

Mr Barrett entered a plea admitting the alleged breaches of Rules 10, 13 and 23.

Sanctions

  • Conduct rule 10: £250
  • Conduct rule 13: £1,500
  • Conduct rule 23: £250

In addition, the costs of this Hearing of £507.60 were imposed against Mr Barrett in favour of Propertymark.

Closing Statement

The Tribunal made the following statement:

'The Tribunal thanks both Ms Rahi and our member, Mr Barrett, for attending at today’s Hearing. Their attendance has greatly assisted the Tribunal. Mr Barrett, kindly, has admitted breaches of the Rules. In relation to the service provided to Ms Rahi, the Tribunal felt that she was not afforded a professionalism service to the standard expected of Propertymark. With regards to other Rules breached, it is noted that these have now been corrected and are up to date.'
