Digital Markets, Competition and Consumers Act 2024: What you must know

This new legislation replaces the Consumer Protection Regulations and governs compliance in the sales and letting agency sector.

In particular, in such matters as the provision of Material Information and the setting out of costs and contractual terms when making an 'invite to purchase', agents need to ensure they are providing the average consumer with the transparency of information they need in order to make a transactional decision in a timely manner.

Supervision has passed from Trading Standards to the Competition and Markets Authority (CMA) and the penalties for non-compliance are significant both in terms of fines but also via redress scheme awards, compensation payments and adverse PR.
